Thank you for your email.
It seams to me your email boils down to,
in my words not yours: procedures are
not in place for certain aspects of
decision making for the organization; an
example of this is 7 people being added
to the ICC board last year without
having been elected to do so; and that
the election committee should govern and
adjudicate the acclamation of the 7
board members without it having been put
to a vote; but simultaneously that the
election committee it is not authorized
to interpret and act on things that are
not explicitly set out in the bylaws of
the ICC. I appreciate I'm simplifying
many and points raised in your email. I
am choosing to answer your concerns more
generally
Here's my personal opinion on the above.
As with many organizations, especially
volunteer based ones, the ICC bylaws do
not cover decision making processes and
requirements for all aspects of the
operational needs of the organization.
In between the areas of silence and
broadly available interpretations,
members of this community continue to
operate, chipping away at those gaps as
they can along the way. The reality is,
no organization is going to run out and
get a legal opinion for very situation
that isn't spelled out in the bylaws.
Even if it did, the point of a legal
opinion is that different people could
have different opinions on how to
interpret something in the bylaws or how
to devise a process for things not
addressed in the bylaws; this is in fact
what lawyers, judges and academics do
for a living - trade off legal
opinions. Organizations could either:
put money into lawyers to firm up the
bylaws and devise policies for its
operations, which could then be put to
the members for approval; volunteer
members could put time into trying to
develop those amendments themselves
little by little through consensus
building; or a mix of both. I am aware
of both of these approaches having in
fact been used by the ICC: I am aware of
at least one situation in which the ICC
members sought a legal opinion on a
particular issue, and I am also aware
and participated in volunteer efforts to
draft changes to the bylaws which were
accepted by the ICC members at last
year's AGM. There is still a long road
ahead. The
question is how to govern along the
way. Will we engage in “moch giri” for
perceived shortcomings, or use our
resources and energy to plug the holes
we discover as we move our community
engine forward.
To answer your concerns though, I’m a
bit puzzled. If
you are of the opinion that an election
committee should somehow hold the
present board members accountable to,
for example the acclamation of 7 members
without a vote, but are not authorized
to do anything not specifically in the
bylaws, where would we get the authority
to do that? The
present interpretation of the bylaws has
been that the board is responsible for
all decision making about the process
for nomination and the election,
including what goes on the ballots,
etc., while the election committee
simply overseas and administers the
processes dictated by the board in the
limited mandate that the board gives us. If
we want the election committee to have
more of a role in that process, we need
to develop the systems for it. And
yes, I’d be more that happy to share my
experiences over the last 3 years in an
effort to devise such processes.
In terms of reporting of the election
committee, there has been no conscious
decision to report or not report certain
things; each year’s committee simply
reported on what it thought was
relevant. Looking
back though, especially in the first
year I was on the board, we did
adjudicate many circumstances that did
not make it to our report. In
all honesty, some of the things that
happened that year were truly
embarrassing with grown adults knowingly
acting in truly unacceptable ways. Maybe
paternalistic efforts to minimize the
dirty laundry of such experiences is
inappropriate and we should in fact
report on every thing that happens so
that our community is aware of all the
antics that go on. This
is especially a concern when you see
that our community newspapers don’t
really cover the elections in any great
detail. With
the exception of Salam Toronto, I didn’t
notice any coverage of this year’s
elections except for an op-ed about it
in Shahrvand. I’d
like to hear the opinion of our
community members on this actually:
would they like everything reported
on, which in volatile years like the
2015 elections could be quite lengthy,
or simply on overall report on outcome.
Overall though, the ICC is a relatively
young organization. Its
processes will become more codified and
refined as the years go by I’m sure. In
the meantime, I hope, as a community, we
can turn our focus from what’s missing,
to how we can improve. As
a colleague put it so precisely once, no
other community in Canada experiences
the internal struggles of our community
whose present country’s government is at
odds with its country of origin. Of
course, there are significantly
differing view points as to the needs
and goals of our community. I
hope we can cultivate an environment
where those differing viewpoints can
co-exist, and each compete in a
respectful manner for the support of our
members.

این ایمیل را چند لحظه پیش
برای پانته آ جعفری، کمیته نظارت بر انتخابات
2017، مهردخت هادی، محبوب بلندی (کمیته
انتخابات2016)، سلمان سیما و مهدی کوهستانی
نژاد (کمیته انتخاباتی 2015 ) فرستادم.

ترجیح
میدادم که نیازی به نوشتن این نامه نمیبود. از
طرفی هم افسوس میخورم که چرا سه سال پیش این
کار را نکردم. بی شک اگر این عمل قبلن صورت
گرفته بود به احتمال قوی بسیاری از مشکلاتی که
در انتخابات اخیر با آن مواجه شدیم دیگر وجود
نمیداشتند. با اتکاء به نکات زیر به خود اجازه
میدهم که انتظار بیشتری از شما داشته باشم:
- وکیل دادگستری و آشنا با قوانین هستید
- حداقل سه سال در کنگره ایرانیان عضو بوده
اید
- در سال 2015 عضوی از کمیته بازبینی اساسنامه
بوده اید
- سه سال متوالی یکی از سه عضو کمیته نظارت بر
انتخابات بوده اید
انتظارات
و افسوسم دو چندان میشوند زمانی که در گزارش
امسال خود در مجمع عمومی به پروتوکلی اشاره
میکنید که یکی از داوطلبین از مدت ها قبل تهیه
کرده، به هییت مدیره ارائه داده، ولی متاسفانه
به آن توجهی نشده است.
در
هرسه سالی که جنابعالی در کمیته نظارت مشارکت
داشته اید خلاف هائی صورت گرفته اند که
یادآوری آنها برای رساندن پیام من بی مورد
نخواهند بود.
- در سال 2015 که جنابعالی به اتفاق سلمان
سیما، و مهدی کوهستانی نژاد در کمیته نظارت بر
انتخابات حضور داشتید، اعتراضاتی مطرح گردید
که در دست داشتن اطلاعات بیش از هزار عضو
کنگره توسط بیژن احمدی که آن زمان یکی از
کاندیدا های انتخاباتی بود، ایشان را در
موقعیت برتر قرار داده و این مورد تبعیضی به
حقوق دیگر کاندیدا ها بود. انگاری بعد از ساعت
ها گفتگو میان اعضای هییت نظارت و بیژن احمدی،
ایشان با فرستادن اخطار قانونی از طرف وکیل
خود هییت نظارت را در موقعیتی قرار میدهد که
مجبور به نادیده گرفتن این مورد شود. اگر این
حرکت را خطا ندانیم، حداقل عدم ذکر این مورد
در گزارش کمیته نظارت بی شک یک خطا به حساب
میاید.
- در سال 20166 با حضور جنابعالی، مهردخت هادی،
و محبوب بلندی در کمیته نظارت، هییت مدیره
خلاف ضوابط تعیین شده در روز انتخابات به عضو
گیری پرداخته و اجازه میدهد که آرائی از این
طریق در صندوق رای ریخته شوند. در ضمن به علت
برابر بودن تعداد کاندیدا ها با جاهای خالی در
هییت مدیره انتخابات برگزار نمیشود. هییت
نظارت از طرف خود تصمیم میگیرد که هفت کاندیدا
را اعضای رسمی هییت مدیره اعلام نموده و مغایر
با اساسنامه دوره خدمت آنها را دو سال اعلام
میدارد.
- در انتخابات 20177 امسال نیز، با اینکه خلاف
سال گذشته که در انتخابات امسال تاثیر گذار
میبود، به اطلاع کمیته نظارت، متشکل از
جنابعالی، امیلی هودی و پیمان نهرور، میرسد،
آنرا نامربوط دانسته و به آن توجهی نمیشود.
کمیته نظارت با همان رویه با اعتراضات دیگر
برخورد میکند:
1- روش نا مناسب در انتخاب اعضای هییت نظارت
2- عدم شرکت در انتخابات اعضای هییت مدیره غیر
منتخب برگرفته از خطای سال قبل
3- گزیینش نامناسب نحوه رای دهی، یک رای برای
هر چهار کاندیدا
4- انتخابات آنلاین
5- تداخل و تضاد منافع رئیس و نایب رئیس
همزمان با کاندیدا بودن آنها
66- ثبت غیر قانونی فدرال کنگره
با اعتقاد بر دو اصل زیر
انتظار میرفت که اعضای هییت نظارت در بررسی
اعتراضات، جوابگوئی و اقدام، مسئولانه تر
رفتار نمایند:
-
تعبیر و تفسیر نکاتی که اساسنامه در باره آنها
سکوت کرده، مبهم بوده، پیش بینی نکرده و یا
ناقص بوده میبایست در جهت حمایت از منافع و
حقوق اعضاء صورت گیرد و نه حمایت از هییت
مدیره.
-
انتخاب اعضای هییت نظارت توسط هییت مدیره
نباید آنها را به حامیان آنها مبدل سازد.
به نظر من جنابعالی با تجربه
های بدست آورده در سه سال گذشته، مناسب ترین
فرد برای تهیه پروتوکل انتخاباتی برای کنگره
ایرانیان میباشید. از این رو در این نامه شما
را مخاطب اصلی قرار داده، امیدوارم موافقت
نموده، و فعالیت در این زمینه را با کمک
داوطلبان دیگر از هم اکنون آغاز کنیم.

Here is the final report from
the 2017 Election Committee of
the Iranian Canadian Congress:
Dear Members of the Iranian
Canadian Congress,
The ICC Election Committee is
proud to announce the following:
A successful and transparent
election was held on Sunday, May
28, 2017 with polls open from
11am to 4:00pm;
1) Online voting: was
administered for the first time
this year through an online
software, electionbuddy, which
was chosen by the ICC Board of
Directors (the Board) from
Saturday, May 20, 2017 at 9am to
Saturday, May 27, 2017 at 2pm in
accordance with the ICC by-laws:
-
The software was secured
with no access by the Board
or anyone else prior to the
commitment of the online
vote. The software is also
designed so that no changes
can be made to the voting
process once the vote has
been initiated.
-
A total of 295 members were
eligible for online voting
and sent instructions for
doing so. Of those 295
members, 190 voted.
-
The result of the online
vote was only known to the
one (1) Election Committee
member in charge of
administering the online
vote until the completion of
the vote count on the day of
the AGM.
2) Voting the day of the AGM:
-
By the start of voting on
the day of the AGM, we were
advised by the Board that
the ICC had 498 members as
of the cut of date of
eligibility on May 25th,
2017:
-
An additional 20 members
renewed their membership on
the day of the AGM;
-
As those who voted online
where not eligible to vote
again in person, of the 518
members eligible to vote in
the 2017 election, only 328
were eligible to vote in
person.
-
A total of 180 people voted
in person or by proxy on the
day of the AGM.
3) Outome of the Election.
-
The ICC had 518 members
eligible to vote in this
years AGM.
-
Of the 518, 190 voted online
with another 180 voted in
person or by proxy the day
of the AGM.
-
The result of the voting
process was as follows:
i. Motion 1: Acclamation of
Board Members – 355 for; 7
against.
ii. Motion 2: Federal
registration of the ICC – 355
for and 9 against.
4) Irregularities raised:
The Election Committee had 2
formal complaints raised to it.
The first dealt with a new issue
for the Board and the Election
Committee around online voting;
the decision of the Election
Committee with respect to same
is available here.
The second complaint dealt
largely with issues the
committee felt was outside of
its jurisdiction and mandate.
No additional irregularities
were raised by way of the formal
complaint process in place for
the day of the AGM.
5) Destruction of IDs and
proxy forms: Please note the
personal information of those
who voted by way of a proxy will
be destroyed by the Election
Committee. The committee thanks
voters for trusting the
committee with their personal
information in our efforts to
safeguard against any concerns
of irregularity that may have
been raised.

wonderful volunteers for helping
make this election a success.

EC Announcement - Elections Procedures

Dear ICC Members,
The Election
Committee would like to welcome
you to participate in the 2017
Iranian
Canadian Congress elections.
The elections will be held on May
28 th , 2017 from 11am – 4pm at
the North York Civic
Centre - Chamber.
Please take note of the
following important details:
1.
Eligibility to vote:
a. Only the following members
are eligible to vote on the day
of the AGM:
i. Those who became a member by
the previously announced
deadline of midnight on May 25,
2017;
ii. Those who were members from
May 16, 2016 to May 28, 2017 and
renew their membership on the
day of the AGM;
iii. Those who have not voted
online; and
b. Who
present a valid ONTARIO ID.
2. Absentee/Proxy
voting:
a. If you have
yet to cast your vote but are
unable to vote in person on the
day of the AGM, you may
authorize a proxy to vote on
your behalf in person.
You will have to provide the
proxy with:
i. a copy of your valid Ontario
ID; and
ii. the following proxy form
dully executed by you:

b. Please note proxy voters do
not need to be ICC Members.
3. What is being voted on:
a. The following two motions
appear on the ballots voted on
online and to be voted on the
day of the AGM:

Board of Directors; and
ii. For the ICC, who is
presently incorporated as a
provincial
organization, to seek
registration as a Federal
Organization.

4. Quorum: Please
note that quorum for initiating
the AGM is fifty (50) per cent
of the ICC members plus one (1).
The total number of members whom
must vote in order to meet this
quorum will be finally
determined by the number of
expired members who renew their
membership on the day of the
AGM.
5. Noting Irregularity
A formal complaint regarding the
live voting process on the day
of the AGM or the ballot count
must:
a. Fill out an official
complaint form available at the
site of the AGM and the counting
stations thereafter;
b. Attach proof of the complaint
and list of any witnesses;
c. Supported by
and filed on behalf of at least
one of the four (4) candidates
running for a position; and
d. File same with a member of
the Election Committee or by
emailing it to
electioncommitteeicc@gmail.com
within one (1) hour of the
completion of the vote count.

Please note the
Election Committee
2017's responses to
your concerns as
follows:
At the outset, we
would like to
clarify the mandate
and role of the EC
as you have raised
many concerns which
fall outside of our
jurisdiction. In
accordance with the
ICC by-laws, our
mandate is limited
to being "in charge
of administration
of the election
process and making
the announcements
after the election
has been concluded."
(Article 5, Section
3), and posting
the results of same
on the ICC website (Article
5, Section 3), with
possibly additional
jurisdiction to run
a by-election in the
event of a vacancy
(Article 4, Section
12). We have no
jurisdiction over
the date, time,
place of the AGM,
nor the motions to
be put to a vote
which is
administered by us.
Where the bylaws are
silent, all members
of the Iranian
community, whether
the ICC board, the
EC or members at
large, try out best
to navigate based on
our interpretation
until and unless
same are addressed
through revisions to
the by-laws
themselves. These
interpretations may
at times be guided
by legal opinions
from external
counsel, which in
themselves may
differ.
1) Acclamation of
2016 candidates
without a vote at
the AGM
As noted in our
previous email, the
2017 EC cannot
comment or rule on
the actions of the
2016 EC. It is
entirely outside the
mandate given to us
by the ICC board
when appointing us
to this year's EC.
Any objection with
the voting process
of the 2016 election
ought to have been
put to the 2016 EC,
or alternatively
raised with the ICC
board.
With respect to the
present election, we
note that the two
candidates that
withdrew their
nomination did so
with sufficient
notice that the ICC
board was able to
modify the printed
ballots to be voted
on. As such, the
process for
acclamation in the
present election is
being put to a vote
at the AGM.
With respect to your
concern that the
four candidates
should have been put
forward for
acclamation
separately (noted in
your email as part
of the second point
below but more
appropriately
responded to within
this section),
please note that the
EC has no control or
say over the motions
put forth at the AGM
as noted above.
Concerns regarding
the choice of what
to put forward to a
vote should be
directed to the ICC
board accordingly.
2) Participation of
Bijan Ahmadi and
Soudeh Ghasemi in
election process
We note your
objection to the
fact that present
members of the board
are running for
another term and, as
such, may be
operating with a
conflict of interest
when making
decisions with
respect to the
present election.
At the outset of our
mandate, at our
initial meeting with
the ICC board, we
inquired into same
with the present ICC
board and were
advised that Mr.
Ahmadi and Ms.
Ghasemi have in fact
abstained from all
board votes with
respect to the
election. From our
understanding, the
board's meetings and
their minutes are
public and are
available on the ICC
website.
We respect to your
allegations that the
election was
postponed to allow
either candidate to
participate in the
election, again, the
details of the AGM
such as choosing the
date it is to be
held is outside the
jurisdiction of the
EC. Our mandate is
simply to administer
the process for
voting and
announcing their
results. Thus, any
issues with the
chosen date for the
AGM ought to be
directed to the ICC
board.
With respect to
access to candidates
through Facebook
only, please note
that the EC's
mandate did not
entail administering
an all-candidates
meeting. Therefore,
it is outside our
mandate to opine on
the manner chosen
for such a meeting
by the ICC board. We
do note, however,
that all candidates
will be available
for questions from
11:30am the day of
the AGM.
3) Seeking federal
registration
Please clarify and
state specifically
which section of the
by-laws you believe
are violated by the
motion seeking
authorisation to
register the
organisation
federally as we do
not see within it
any section that
seeks to limit the
content of motions
put to a vote at an
AGM. In fact,
from review of the
by-laws, the
language used and
articles within it
suggest that a
federal jurisdiction
for the organisation
was the intent at
its formation, but
that it was
registered
provincially
none-the-less. For
example, we note
Article 2, Section
3, notes that "ICC
business will be
conducted within
Canada in 5 distinct
geographical regions
as follows: Ontario,
Quebec, Pacific
region (British
Columbia , North
West Territories,
and Yukon
Territory), Atlantic
region (Nova Scotia,
New Brunswick,
Newfoundland, Prince
Edward Island and
Territory of
Nunavut), and the
Prairies region
(Alberta, Manitoba,
and Saskatchewan)".
The ICC cannot
operate in the
stated regions
unless it seeks
extraterritorial
registration which
the motions seeks to
address.
4) No announcements
from the EC
You are correct that
this year's EC was
not able to meet the
deadline for
submission of a
formal announcement
in the community
papers prior to the
AGM occurring. We
are a committee of
volunteers doing our
best to ensure the
successful
administration of
the election
process. Formal
announcements from
the EC can be found
on the ICC website
under the "News"
tab.
With respect to the
instructions for
online voting,
please note, as
confirmed in a joint
video by a member of
the ICC board and of
the EC last week,
and which will be
included in the EC's
final report, the
ICC board had not
access to the
election server
after transferring
to the EC the list
of eligible voters.

نامه دوم مهدی شمس به هییت نظارت بر
انتخابات

با تشکر از جوابگوئی شما
- نکاتی
که در نامه قبلی و این نامه میاورم
میبایست به عنوان شکایت تلقی شوند.
انتخابات زمان و مکان دیالوگ نیست.
با تکیه بر اصل زیر به ارائه خلافکاری ها
که به انتخابت مربوط میشوند میپردازم:
- بهره
گیری از نواقص، سکوت و یا تفسیر و تحریف
اساسنامه در جهت تبعیض و تعرض به حقوق
اعضاء غیر قانونی، غیر اخلاقی و خلاف
میباشند.

نکات مورد اعتراض من:
خلاف های سال گذشته که در انتخابات امسال
تاثیر گذار میباشند.
- معرفی
و به رسمیت شناختن کاندیدا های سال قبل
توسط هییت نظارت زمانی که انتخاباتی صورت
نگرفته است در محدوده تصمیم گیری این
کمیته نبوده و خلاف میباشد.
- اعلام
عضویت هفت عضو غیر منتخب به عنوان اعضای
هییت مدیره برای دو سال مخالف اساسنامه
میباشد. طبق اساسنامه اعضای هییت مدیره
غیر منتخب میبایست در اولین انتخابات شرکت
کنند.
دخالت بیژن احمدی و سوده قاسمی در تصمیم
گیری هائی که به انتخابات مربوط میشوند
تداخل منافع بوده و غیر قانونی میباشند.
- به تاخیر انداختن انتخابات برای یک
هفته جهت همکاری با سوده قاسمی که
نمیتوانست زودتر از آن در روز انتخابات
حضور داشته باشد تبعیض میباشد.
- با علم بر اینکه بخشی از اعضاء دسترسی
به کامپیوتر، و اینترنت ندارند، مناظره
کاندیدا های امسال از طریق فیسبوک برگزار
میگردد تا از رودروئی معترضین و پرسش و
پاسخ سئوالات آنها از بیژن احمدی و سوده
قاسمی جلوگیری به عمل آید.
- سئوال برانگیز است که چرا اعضای کمیته
نظارت به موردی به این واضحی توجه نکرده،
بخصوص که در سال 2015 چنین مشکلی در رابطه
با بیژن احمدی پیش آمده و در آن زمان نیز
پانته آ جعفری عضوی از هییت نظارت بوده
است.
- تعیین روش رای دادن همزمان به چهار
کاندیدا که نتیجه اش تاثیری بر پیوستن
آنها به هییت مدیره نداشته، تعرض دیگری به
حقوق اعضاء، و به نحوی جلوگیری از اظهار
نظر اعضاء در رابطه با تک تک کاندیدا ها،
بخصوص بیژن احمدی و سوده قاسمی میباشد.
ثبت فدرال کنگره ایرانیان مغایر با
اساسنامه است در نتیجه به رای گذاشتن آن
در مجمع عموی خلاف میباشد.
هییت مدیره بدون آنکه از قبل با اعضاء
موضوع ثبت فدرال را در میان بگذارد، در
باره آن اطلاع رسانی کرده و گفتگوئی به
عمل آورد، اعضاء را قافلگیر کرده، ثبت
فدرال را که بر خلاف اساسنامه میباشد را
مطرح کرده است.
عدم
صدور بیانیه از طرف هییت نظارت
متاسفانه
امسال کمیته نظارت بر انتخابات در اطلاع
رسانی و انتشار بیانیه کوتاهی کرده و برای
اعضاء مشخص نیست که در رابطه با انتخابات
آنلاین چه مکانیزمی تنظیم شده که نه برای
هییت نظارت و نه برای هییت مدیره این
امکان وجود داشته باشد تا از نتایج آن قبل
از پایان انتخابات مطلع گردند. اگر به هر
نحوی امکان مطلع شدن برای هییت مدیره و یا
هییت نظارت وجود داشته باشد خلاف و غیر
قانونی به حساب خواهد آمد.
در ضمن یادآوری میشود که اینجانب از ماه
ژانویه قصد خود را برای شرکت در انتخابات
بصورت عمومی اعلام نمودم. ولی متاسفانه
بعد از تماس های مکرر با هییت مدیره،
اشاره و تاکید بر خلاف ناشی از مورد
تداخل منافع که در این نامه به توضیح آن
پرداختم و مشاهده بی اثر بودن آنها، از
شرکت در انتخابات منصرف شدم. انتظار دارم

ICC board secretary regarding
membership deadlines:
Dear ICC Members,
If you'd like to vote in the
upcoming ICC Annual General
Meeting on Sunday May 28th, 2017
please note that registration
deadline is tonight before
midnight (May 25, 2017 by
11:59PM).
Please note that on the day of
the AGM, only those whose
membership have expired since
the last ICC AGM will be able to
renew their membership
(expiration dates between May
16, 2016 to May 28, 2017). If
you have any doubt, we suggest
you renew using the online
membership form before the
deadline tonight.
New members joining on the day
of the AGM will be allowed to
attend the General Meeting but
will not be able to vote. Once
again the deadline for new
members to register is tonight
before midnight. After midnight
we will close the online
registration till after the AGM.

2017 is proficient

First, please note
that the composition
of this year's
Election Committee
is different from
the last, and we
cannot comment on
what did or did not
happen within their
purview and
control. You seem
to have directed
most of your
comments to Ms.
Jafari directly, who
is only one member
of a three-member
committee. We will
try to address your
concerns as best we
can with respect to this year's
election under our
direction.
As for the content
of your concern, if
we understand
clearly, they are as
follows:
1) that acclamation
of board seats
should be by a vote
at an AGM
2) That board
members running for
a further term of
office should not be
making decisions
relating to the
election or its
process as doing so
would be a conflict
of interest; and
3) that the Election
Committee does not
have the authority
to make
determinations on
process, procedure
or interpretation
where the ICC
by-laws are silent
on same.
Please confirm if
these are the
concerns you have
raised so we can
address same. Also,
please confirm
whether you are
engaging in dialogue

ایمیل را چند لحظه پیش برای هییت نظارت بر
انتخابات ارسال داشتم:

هییت نظارت بر انتخابات، خانم پانته آ جعفری
متاسفانه
باید اعلام دارم که در دوسال اخیر که جنابعالی
عضوی از هییت نظارت بر انتخابات کنگره
ایرانیان بوده اید خلافکاری هائی صورت گرفته
است. با اینکه اعضای هییت نظارت منتخب هییت
مدیره ها میباشند، اعضای کنگره، بخصوص کاندیدا
ها، انتظار دارند که آنها در کمال بیطرفی
قوانین را رعایت نمایند.
در انتخابات سال گذشته در حضور
شما و دیگر اعضای هییت نظارت، تنی چند از
اعضای هییت مدیره به افرادی اجازه میدهند که
بر خلاف ضوابط تعیین و اعلام شده به عضویت
کنگره در آمده و رای در صندوق بیاندازند. در
ثانی شما به اتفاق دیگر اعضای هییت نظارت بدون
آنکه انتخاباتی صورت گیرد اولن هفت کاندیدا را
به عنوان اعضای هییت مدیره اعلام کرده و دومن
دوره مدیریت آنها را برای دو سال تعیین کرده
اید. این تصمیم گیری شما خلاف اساسنامه ای
میباشد که تاکید بر تعیین اعضای هییت مدیره از
طریق انتخابات را دارد. در ضمن شرکت اعضای
هییت مدیره غیر منتخب را در اولین انتخاباتی
که از طریق مجمع عمومی برگزار میشود لازم
دانسته است. عدم پیش بینی در اساسنامه از
شرایطی که سال گذشته با آن مواجه شدیم، که
تعداد کاندیدا ها برابر با تعداد صندلی های
خالی در هییت مدیره بود، این امتیاز را به
هییت نظارت نمیدهد که به جای مجمع عمومی تصمیم
گیری نماید.
شرکت رئیس و نایب رئیس کنونی
در انتخابات امسال باز این نهاد را در موقعیتی
قرار داده است که اساسنامه راه حلی برای آن
پیش بینی نکرده است. بی شک بیژن احمدی و سوده
قاسمی در موقعیتی برتر نسبت به کاندیدا های
دیگر قرار دارند. با اینکه از مدت ها قبل در
رابطه با تداخل منافع به هییت مدیره هشدار
داده شده بود ولی متاسفانه برای رفع این مشکل
اقدامی صورت نگرفت. برای جلوگیری از رودرروئی
رئیس و نایب رئیس با اعضاء و فرار از جوابگوئی،
هییت مدیره مناظره کاندیدا ها را امسال از
طریق سوشیال مدیا برگزار کرد. این خود نمونه
ای از تاثیر گذاری بر انتخاباتی میباشد که دو
تن از تصمیم گیرندگان کاندیدا بوده و در جهت
حمایت از منافع خود اشکالی در تعرض به حقوق
رای دهندگان و دیگر کاندیدا ها نمی بینند. به
تاخیر انداختن یک هفته انتخابات جهت بوجود
آوردن تسهیلات برای سوده قاسمی، نایب رئیسی که
در انتخابات امسال شرکت داشته و در تصمیم گیری
های مربوط به انتخابات صاحب نظر میباشد مورد
دیگری از تداخل منافع میباشد.
در ضمن با انصراف دو تن از
کاندیدا ها همزمان با شروع انتخابات آنلاین،
امسال نیز شرایط خاصی را برای این نهاد بوجود
آورده است، که لزوم تعمق، توجه و نظارت بیشتری
توسط آن هییت در جهت قانونی اجرا شدن انتخابات
را ایجاب میکند. جای تعجب دارد با اینکه
انتخابات آغاز شده است هییت نظارت هنوز بیانیه
ای صادر نکرده است.
خواهشمند
است که به این موارد در اسرع وقت رسیدگی شود.
و با این امید که این نامه باعث شود که در
انتخابات امسال مراقبت های بیشتری صورت گیرند.

مهلت ثبتنام برای انتخابات
آنلاین ۱۲شب پنجشنبه ۱۸ می:
دوستان تجربهی لایو فیسبوک برای
معرفی نامزدهای کنگره به نظرم
تجربهی موفقی بود. نزدیک به ۵۰۰۰
نفر تابهحال تنها یک روز پس از
برنامه به ویدئوها دسترسی داشتهاند
و به میزانی که خواستند ویدئو را
تماشا کردند. بیش از ۱۰هزار نفر
از این ماجرا خبردار شدند و گذری
به برنامه زدند. خوب با یک برنامهی
حضوری امکانش نبود. البته من شخصا
اعتقاد دارم که برنامهی حضوری و
از نزدیک هم لطفی دارد که به هر
حال فیسبوک ندارد. مثل صحبت
رودررو با نامزدها
که در روز مجمع عمومی محقق خواهد
شد.
البته این نکته هم مهم است که
دیروز ۷ سوال از نامزدها پرسیدم
که ۴۴ سوال را خود بینندهها مطرح
کرده بودند بنابراین با استفاده
از تکنولوژی این رابطهی دوسویه
هم تاحد خوبی برقرار شد.
فقط خواستم عرض کنم که
این تجربهی خوبی بود برای من و
اگر در سال آینده بخواهید از این
روش باز هم استفاده خواهیم کرد.
یک استفاده خوب دیگر از
تکنولوژی برگزاری انتخابات
آنلاین هست که در اساسنامه
ذکر شده و هیات مدیرههای
کنگره موظف به برگزاری آن
بودهاند.
این انتخابات آنلاین برای
کسانی که در ایالت اونتاریو
زندگی میکنند ممکن است و در
روز شنبه ۲۰۰ می شروع خواهد
شد.
اگر تمایل دارید در انتخابات
آنلاین شرکت کنید باید تا شب
پنجشنبه ۱۸۸ می عضو شده
باشید. اگر عضو نشده باشید
امکان انتخابات آنلاین را
نخواهید داشت و باید رایتان
را در مجمع عمومی بدهید (مشروط
به اینکه تا قبل از مجمع عضو
شوید)

معمول هستش که کاندیداها در انتخابات سعی به
نزدیک شدن به اعضا دارند و به سؤالات آنها
جواب میدهند اما زمانی که در انتخابات برنده
شدند به بهانههای مختلف خود را از اعضا دور
میکند. حتا کنگرهه از این روال معمول هم خارج
است. از همان اوّل هم خودشون را کنار میکشند.
شاید بد نباشه کاندیداهای امسال, خودی نشان
دهند و در بحثها بیشتر شرکت کنند, که اعضا
آنها را بیشتر بشناسند و با نقطه نظرات آنها
آشنا شوند. وگرنه چگونه میتوان با آنها رای
داد؟ آیا فقط با یک مصاحبه ۲ ساعته فیسبوکی
میتوان آنها را شناخت؟ و یا در روز مجمع عمومی
باید آنها را بشناسیم؟

Election Update: Election Committee and
Proxy Voting - AGM 2017

Here is an update about the
upcoming AGM and Board Elections:
Election Committee
The following
individuals have been appointed to the Election
Committee for the upcoming AGM and Board
Elections on May 28, 2017. The election
committee will administer and monitor the online
voting process from May 20-27 and the voting
process on May 28th.
Pantea Jafari,
Emily Hoody, and Pouyan Nahrvar.
All three
members have previous experience with election
administration. We are grateful for their help
in this process.
Legal Counsel
The ICC Board of Directors has retained Mr.
Esmaeil Mehrabi from Mehrabi Law Office as
legal counsel to advise the board for the
AGM and elections procedure. This is an
additional step that the board has taken to
ensure that all applicable laws and
regulations are followed during the AGM and
the board elections.
Here you can
find info about proxy voting in the upcoming AGM
on May 28, 2017:
Proxy Voting
Any member
who cannot attend the Annual General Meeting in
person may vote through a proxy by filling out
the proxy form and attaching a copy (digital or
paper copy) of his/her photo ID to the form. The
proxy holder shall present the signed form along
with the copy of the photo ID of the person
he/she is representing to the election officers
at the Annual General Meeting.

voting process is according to the Ontario
Corporations Act (article 84.1) and the proposed
Non-Profit Corporations Act (article 64.1).

با درود و عرض ادب خدمت شما همراهان
زمان میگذرد و لحظه ها سپری میشود و
من یکسال دیگر دور از وطن وخانه پدری
در کانادا زندگی میکنم .کانادا خانه
ای دیگربرای من شده است .این خانه
زیبا، خانه من نیست ولی نمیتوانم از
موقعیت ها و فرصت های که به عنوان یک
مهاجر در اختیار من قرارداده است
سپاسگزار نباشم . تجربه کار ، تحصیل
، وزندگی دوازده ساله درکانادا وشرکت
و یا عضویت در فعالیت های مختلف
فرهنگی ، اجتماعی و سیاسی در
کامیونیتی های مختلف من جمله ایرانی -
کانادایی من رابرآن داشت که از این
تجربیات در ابتدابرای کامیونیتی
ایرانی خود استفاده کنم چراکه ایران و
ایرانی بودن نقش بی بدیل و بسزایی در
پرورش رشد فکری و اجتماعی و سیاسی تک
تک ما داشته است . به عنوان یک ایرانی
مهاجر اعتقاد دارم که هرایرانی باید
نسبت به سرزمین و مردمش ادای دین
نماید . حال که شرایطی برایم فراهم
نیست که آموزه های خودرادرسرزمینم
درخدمت مردم شریف و نجیبم قراردهم
برآن شدم که در کامیونیتی ایرانی
درکانادا که همواره ایرانی کوچک برای
تک تک ماست نسبت به این مهم اقدام
نمایم و عضوی موثرتر و مفید تر باشم .
با توجه به فعالیت های داوطلبانه ام
در کانادا ، در شهرهای مختلف من جمله
، تورنتو ، آتاوا و مونترال در مراسم
ها چه به عنوان برگزارکننده و چه به
عنوان داوطلب همواره علاقه و حساسیت
خودرا به فعالیت های اجتماعی ، سیاسی
، فرهنگی ابراز داشته ام .درضمن تجربه
عضویت چند ساله در انجمن ایرانیان
کانادا وعضویت فعال دریک سال اخیر چه
به صورت مشاور وچه به عنوان داوطلب
درزیرگروه تخصصی این انجمن مرابیشتر و
بیشتر با این سازمان همراه کرد .
آشنایی با نقاط ضعف و قوت این نهاد
اجتماعی ، سیاسی ، فرهنگي شرایطی
ایجاد نمود که با دیدی جامع تر و وسیع
تر دراین راه قدم بردارم.دغدغه هاي
فرهنگي در جامعه نوپاي ايراني و نبود
آن در كنگره بصورت منسجم و همچنين بحث
مشاركت فعال زنان پرتوان و انديشمند
از نكاتى است كه همواره مد نظرم بوده
است و اميدرارم پيگيري نمايم . حضور و
همراهی درکنار نخبگان سیاسی ، اجتماعی
و فرهنگی همچنین سازمان های مختلف
ایرانی دراروپا، کانادا وآمریکا و
تجربه آموزی از دانشگاه بزرگ شما مردم
مهربان که همان دانشگاه زندگی است مرا
برآن داشت که اینبار خود درس آموخته
های محضر زندگی را در امتحانی دیگر
خدمت شما عزیزان تقدیم نمایم و خود را
برای عضویت در هیات مدیره این نهاد
سیاسی ،اجتماعی و فرهنگی کاندید نمایم
و در برابر رای شما قرار دهم .
امیدوارم مثل همیشه با کمک و راهنمایی
و همراهی شما عزیزان فردای بهتر برای
جامعه نوپای ایرانی-کانادایی فراهم
سازیم .

Nomination Statement
Dear Friends,
After much consultation with my
colleagues and many of our
active members at the Iranian
Canadian Congress (ICC), I have
decided to run in the upcoming
ICC elections to continue my
involvement with the Board of
Directors. I believe the ICC is
at a critical juncture, and I
see it as my duty to continue
serving the organization to
ensure its long term growth and
success.
Upon joining the ICC as a member
and volunteer three years ago, I
soon realized that the
organization was in need of
serious reforms. In the first
two years, first as a volunteer
and then as the public relations
director, I focused my efforts
on community outreach to attract
supporters and volunteers and to
encourage the younger generation
to participate in the ICC.
Over the past 12 months, I have
had the honour of serving as the
President of the ICC. With the
help of my talented team, we
were able to significantly
improve the work of the
organization, expand our reach
within the community, and
effectively advocate for the
interests of Iranian Canadians
at the highest levels of the
Canadian political system.
I believe the positive results
of our work speaks for itself.
In only 12 months, the number of
supporters in our audience
network has increased from 4,000
to nearly 10,000 people
nationwide. For the first time
in the decade-long history of
the organization, the ICC has
recruited local volunteer teams
in all major cities and
provinces across the country.
Today, the ICC is stronger than
ever before in its ability to
serve our community. However,
there is still a lot of work
that needs to be done to ensure
the ICC stays on its path toward
long term success. I believe
that I have the skills, the
experience, and a proven track
record to lead the ICC in the
right direction in this critical
moment in the history of our
community. I therefore ask for
your vote of confidence on May
28th so
that I can continue serving our
community as a member of the ICC
board.

Nomination Statement
After immigrating to Canada
from Iran in late 2004, I
further pursued my education
and career and I currently
hold Charted Professional
Accountant designation. I am
fluent in both Farsi and
English allowing me to
better connect with my
fellow Iranian-Canadians. I
have been working in
different areas of
accounting and finance for
the past seven years
including teaching at the
Seneca College.
Previously I served as the
Chief Financial Officer (CFO)
for the OMID foundation
Toronto chapter, a
registered charity, that
empowers disadvantaged young
women in Iran. I have also
been heavily involved with
the Liberal Party of Canada
during the federal election
for the Markham-Thornhill,
Willowdale and Richmond Hill
area. I joined the UN
Habitat in 2016 and worked
closely with the Executives
of the organization to
promote and introduce the
New Urban Agenda to the
leaders of countries across
the globe during the United
Nations Conference on
Housing and Sustainable
Urban Development (Habitat
III)
I am compassionate about
giving back to the community
and have volunteered my time
as the Vice President of the
Iranian Canadian Congress
for the past two years. I am
a strong advocate of
promoting and protecting the
rights, freedoms and
interests of all Iranians in
Canada while encouraging
Iranian-Canadians to achieve
unity in order to reach our
common goals. During this
process, I was able to
mobilize our community
members around important
issues which affects a large
number of community members,
encouraged them to raise
their concerns and to be a
part of a democratic
process. As a result ICC is
now a strong voice for our
community. I hope to
maintain this initiative if
elected for the second term
as a board member of the
Iranian Canadian Congress.
Hooman Shirazi

Nomination Statement
Hooman Shirazi is an IT
professional and the founder
of the consulting firm
Shirazi Brothers Inc., with
more than 12 years
‘experience. He holds a
B.Eng. Hon. in Computer
Engineering (Software) from
Sheikh Bahaei University,
Esfahan, Iran and a Master’s
Degree from the University
of Ottawa in Engineering
Management (2013). Hooman
has a broad array of
experience across the IT
industry, including
consulting for
communications firms,
Microsoft, the Government of
Canada, and AON.
Hooman has always been
deeply engaged in social,
cultural, and political
activities. During his years
at University in Iran, he
was elected as a Student
Representative for four
years and was a founding
member of a Literature and
Cultural Society. After
moving to Canada, Hooman has
volunteered extensively in
Toronto, Ottawa, and
Montreal supporting various
community initiatives. At
the
University of Ottawa, Hooman
had the privilege to
organize numerous talks and
events. Hooman traveled to
Stockholm, Sweden in 2011 to
present the Tirgan Festival
and he was part of Tirgan
advisory board in Tirgan
2012, as well as Iran's day
in Montreal.
Since 2013, Hooman has been
involved with the Liberal
Party as a volunteer in
Willowdale. He was one of
the volunteer during the
2015 election, campaigning
for one of Canada’s first
two Iranian-Canadian. Hooman
currently serves as an
Iranian Public Advisor with
many organizations working
to engage the broader
Iranian-Community across
Canada. Hooman was also an
organizer of the event for
Iranian’s MPs to engage
with Iranian-Community across
the Canada in 2016. Hooman
helped organize Nowruz
1395 on Parliament Hill --
the first time the Iranian
New Year was celebrated in
Canada's Parliament. In
March 2016, Hooman was
elected to serve on the
Board of Directors for the
Liberal Party’s Willowdale
Electoral District
Association.
Hooman has been a member of
the Iranian Canadian
Congress since 2015, and he
has been actively working as
a project advisor in the
professional committee.

Morvarid staunchly values
and believes in one’s
engagement and
participation, in the active
furtherance, and serving of
one’s Community.
As a BSc. Spec. Hons.
Kinesiology and Health
Sciences student at York
University, she worked in
fostering Student Success,
Community Engagement, and
Leadership Development. She
has led the Iranian Students
Association at York for 4
years, as the Director of
External Affairs,
Vice-President, and is
currently leading the
Executive Board of
Directors, as the President.
Morvarid has experience
working with the Iranian
Canadian Congress (ICC) as
former Planning and
Communications Intern. This
position provided her with
comprehensive knowledge and
hands-on experience in
identifying and recognizing;
community needs and
concerns, as well equipped
her, to assist ICC Board of
Directors in a number of
projects, events, and
initiatives;
serving the community.
Morvarid has worked at the
Student Community and
Leadership Development, and
the Health Aid Network. She
has volunteered with
Mackenzie Health Hospital -
Elder Life Program for 5
years; with Free the
Children, Canadian Cancer
Society, Heart and Stroke
Foundation, and Peace by
PEACE (Playful Exploration
of Active Conflict
Resolution Education).
At the York Federation of

the Canadian Federation of
Students (CFS), Morvarid

Nomination Statement
Yasamin Dadashi moved to the UK
after completing her undergraduate degrees in
Tehran to continue her studies. She obtained a
masters degree and a PhD in Human Factors and
has been working as a consultant in England and
Canada for over ten years.
Yasamin
serves as the executive director of Omid
Foundation Canada, a registered charity
organization committed to strengthening the
social, emotional and economic opportunities
of disadvantaged young women in Iran. She
found out about Omid Foundation after she
watched a documentary about their work. She
was so impressed by the work of the
foundation that she decided to support them.
Together with a few friends, she started
organizing fundraising events for Omid
Foundation in Toronto and now after three
years, Omid Foundation Canada has
successfully been working to raise awareness
and funds in the Iranian-Canadian Community
in Toronto and Vancouver.
Yasamin hopes to bring her experience in
non-profit work to the board of the
Iranian Canadian Congress to further
expand and strengthen the organization.

the Annual General Meeting of the Iranian
Canadian Congress and call for nomination:
NOTICE FOR THE ANNUAL GENERAL MEETING OF THE
IRANIAN CANADIAN CONGRESS AND CALL FOR
NOMINATION
When: Sunday May 28, 2017, 2PM
Where: Council Chamber, North York Civic Centre
(5100 Yonge Street)
Dear Members of the Iranian
Canadian Congress,
Notice is hereby given to all members of the
Iranian Canadian Congress (ICC) that the Annual
General Meeting (AGM) of the ICC will be held on
Sunday May 28th,
2018 at 2PM in North York Civic Centre, Council
Chamber in North York, Ontario (5100 Yonge
Street) to conduct the following:
According to the procedure provided in the
bylaws the ICC is facilitating online voting
this year from May 20 to May 27th.
For more information about the nomination
process and voting procedure please review this
email carefully and send us an email at info@iccongress.ca if
you have any questions.
Nomination Procedure: ICC members
interested to run for a position on the Board of
Directors shall follow these steps:
Step 1: Review the eligibility
requirements for board nominees (as per the ICC
by-law):
Must have been a member in good standing for at
least one (1) year immediately preceding
the AGM;
Must be 21 years or older;
Must be a Canadian Citizen;
Must have lived in Canada for at least 5 years
in aggregate;
Must pass a criminal background check.
Step 2: If you meet the eligibility
requirements, to
announce your intention to run send an email to info@iccongress.ca and
submit all required nomination documents before May 4th, 2017,
11:59PM. To meet the bylaw requirements
all nominees shall submit the following
documents to the ICC together with their
nomination email:

A
biography and/or nomination statement in
maximum 300 words. English bio is required,
Farsi bio is optional. Please provide your
bio in a word file.
-
A
passport size photo in digital format. The
photo has to be passport style - clear and
formal.
-
A
certificate of police clearance.
-
Proof of
Citizenship.
Membership cut-off date
ONLY members of the Iranian Canadian Congress
are eligible to attend at the Annual General
Meeting and vote for the election of new Board
members. Therefore, those who become member of
the ICC by the
end of May 18th,2017 (11:59PM) are
eligible to vote for the online
election and those who become member of the ICC
by the
end of May 25th,
2017 (11:59PM) are
eligible to vote in person on May
28th,
2017.
Membership Registration
You can sign up for ICC membership or renew your
membership only in one of the two following
ways:

Online
at www.iccongress.ca/joinicc or
-
In
person with the secretary of the board. For
in person registration please email us at info@iccongress.ca.
Proxy Voting
Members who are unable to vote themselves can
assign a proxy representative to vote for them.
We will send you the proxy form and instructions
in a separate email in the next few weeks.
In the coming weeks we will provide you more
information about the online voting procedure
and the upcoming AGM including early voting
hours on the day of the AGM.
Federal Registration
The Board of Directors of the ICC hereby is
providing notice to all members that during the
coming AGM the board will be introducing a
motion to the AGM requesting approval from
members to register the organization at the
federal level to facilitate the expansion of the
ICC in regions and provinces outside of Ontario.
While the ICC is a national organization based
on its by-laws, the organization was originally
registered provincially in Ontario. In the last
12 months the ICC has expanded its activities
and has recruited local volunteer teams in major
cities and provinces across Canada including BC
and Quebec. To facilitate this expansion we are
aiming to register the organization at the
federal level as well. During the AGM you will
have a chance to vote on this issue.
* Note that due to their personal and
work schedules Mr. Ali Bangi and Mr.
Behzad Jazizadeh will not continue their
involvement with the ICC Board of
Directors after the end of their 1st
year term.

:شرایط نامزدی برای عضویت
در هیات مدیره به استناد اساسنامه کنگره
ایرانیان کانادا به شرح زیر است
الف) عضویت در کنگره
ایرانیان کانادا برای حداقل یک سالِ کامل
که زمان آن بلافاصله پیش از تاریخ
انتخابات پیش رو محاسبه میگردد؛
ب) حداقل ۲۱ سال و یا
بیشتر سن داشته باشند؛
ج) شهروند کانادا باشند؛

قصد عضویت خود را در هیات مدیره کنگره
ایرانیان کانادا به همراه مدارک زیر به
آدرس ایمیل کنگره ارسال کنند

علاقمندی برای عضویت در هیأت مدیره در
حداکثر ۳۰۰ لغت -
یک عکس جدید در اندازهی پاسپورت -
- گواهی عدم سوء
پیشینه از ادارهی پلیس
- گواهی اثبات شهروندی
توجه*
تنها اعضای کنگره میتوانند در مجمع
عمومی شرکت کرده و رای دهند. از این رو
آنهایی که تا پایان روز ۱۸ام ماه مه ۲۰۱۷
به عضویت کنگره در آمده و یا عضویت خود را
تمدید کنند میتوانند در انتخابات آنلاین
شرکت نمایند و آنهایی که تا پایان روز ۲۵ام
ماه می ۲۰۱۷ به عضویت کنگره در آمده و یا
عضویت خود را تمدید کنند میتوانند در
انتخابات حضوری در روز ۲۸ام ماه مه در
مجمع عمومی شرکت کنند
برای عضویت هم میتوانید
به نشانی اینترنتی مقابل رفته و عضویت خود
را به صورت آنلاین تمدید کنید: www.iccongress.ca/joinicx.
یا اینکه برای تمدید عضویت به صورت حضوری
ایمیلی به info@iccongress.ca بفرستید.
ثبت نام برای عضویت تنها از دو طریق ذکر
شده امکان پذیر است.
در روزها و هفتههای آینده
اطلاعات بیشتر و دقیقتری از انتخابات
آنلاین و مجمع عمومی امسال به شما ارائه
خواهیم کرد.
به علاوه در این مجمع
عمومی هیات مدیره طرحی را برای تصویب به
مجمع عمومی اعطا خواهد کرد که به موجب آن
کنگره ایرانیان کانادا در سطح فدرال
کانادا نیز همچون سطح استانی فعلی به ثبت
برسد تا امکان رشد و توسعهی کنگره میسر
شود.
* لازم به توضیح است که دو
عضو هیات مدیرهی کنگره ایرانیان کانادا
آقایان علی بانگی و بهزاد جزیزاده به
دلایل شخصی و کاری پس از اتمام سال اول
خود در این هیات مدیره همکاری خود را
ادامه نخواهند داد. به همین دلیل این
انتخابات برای ۴ صندلی برگزار خواهد شد.
